These Terms of Service ("Terms") govern your access to and use of oceansim.io, including its website, customer dashboard, APIs, virtual-number services, SMS reception services, and related products and services (collectively, the "Services").

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and oceansim.io ("oceansim.io", "we", "us", or "our").

By creating an account, accessing the Platform, adding funds, purchasing a virtual number, using an API, or otherwise using the Services, you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree with these Terms, you must not access or use the Services.

1. Definitions

For purposes of these Terms:

"Account" means a User account created on oceansim.io.
"Activation" means a transaction through which a User obtains temporary access to a telephone number for receiving an SMS, OTP, verification message, or similar communication for a selected Service.
"API" means the application programming interfaces and associated documentation provided by oceansim.io.
"Balance" means prepaid credit available in a User's oceansim.io Account for purchasing Services.
"Number" means a virtual, mobile, or other telephone number made available through the Platform.
"OTP" means a one-time password, verification code, authentication code, or similar message delivered through SMS.
"Service" means a supported website, application, platform, or other service for which a Number or SMS reception capability may be provided.
"SMS" means a text message received by a Number through the Platform.
"Supplier" means a third-party supplier, telecommunications operator, SMS provider, numbering provider, aggregator, reseller, or other third party from which oceansim.io obtains Numbers or related telecommunications infrastructure.
"Platform" means the oceansim.io website, customer dashboard, APIs, applications, and related systems.

2. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services.

By using oceansim.io, you represent that:

The information provided by you is accurate and current.
You are legally permitted to use virtual-number and SMS services in your jurisdiction.
Your use of the Services complies with applicable laws and regulations.
You will comply with the terms and policies of third-party services that you access using an oceansim.io Number.
You will not use the Services for unlawful, fraudulent, abusive, or harmful activities.

If use of the Services is prohibited or restricted in your jurisdiction, you must not use the Services.

3. Nature of Oceansim Services

oceansim.io provides technical access to virtual-number and SMS reception services.

Depending on availability, Services may include:

Temporary virtual telephone numbers;
SMS and OTP reception;
Number activations;
Country-specific Numbers;
Service-specific Numbers;
Network or routing options;
API access;
SMS history;
Account balance management;
Related technical services.

oceansim.io does not originate, manufacture, create, or independently operate the underlying telephone numbers provided through the Platform.

Numbers and telecommunications connectivity are obtained from third-party Suppliers.

The availability, characteristics, history, reputation, and suitability of a Number may therefore depend on the Supplier and underlying telecommunications infrastructure.

4. Third-Party Suppliers

oceansim.io relies on third-party Suppliers to obtain Numbers and telecommunications infrastructure.

Suppliers may include telecommunications operators, numbering providers, SMS gateways, aggregators, resellers, and other service providers.

Because oceansim.io does not originate the underlying Numbers, we cannot guarantee:

That a Number is newly issued;
That a Number has never previously been used;
That a Number has never been associated with another account;
That a Number has never been used for a particular third-party service;
That a Number has a clean history with every third-party platform;
That a Number will remain available for a particular Service;
That a Number will be accepted by a particular third-party platform.

Third-party Suppliers may change, replace, suspend, recycle, or reassign Numbers and may modify their telecommunications infrastructure at any time.

5. Previously Used and Recycled Numbers

Users expressly acknowledge that Numbers available through oceansim.io may be previously used, recycled, reassigned, or otherwise have a prior usage history.

A Number may previously have been:

Assigned to another individual;
Used for account registration;
Used to receive SMS messages;
Associated with third-party applications;
Blocked or restricted by a third-party service;
Reported or classified by a third-party service;
Returned to a Supplier and later made available again.

oceansim.io does not guarantee that a Number has no previous usage history.

Because Numbers are sourced from third-party Suppliers, oceansim.io cannot independently determine or guarantee the complete historical usage of every Number.

Users should therefore not assume that a Number is completely fresh, unused, or free from previous reputation or association.

6. Third-Party Services

When you use an oceansim.io Number with another website, application, platform, or service, you remain solely responsible for complying with that third party's terms and policies.

Third-party services may:

Reject a Number;
Block a Number;
Require additional verification;
Refuse to send an OTP;
Restrict an account;
Suspend an account;
Permanently ban an account;
Detect a Number as previously used;
Apply their own fraud or risk controls.

oceansim.io does not control these decisions.

A Number being available for purchase on oceansim.io does not constitute a guarantee that the Number will be accepted by any particular third-party service.

7. Acceptable Use

You may use the Services only for lawful purposes and in accordance with these Terms.

You are responsible for your use of:

Numbers;
SMS;
OTPs;
Activations;
APIs;
Account Balance;
Any other Oceansim Service.

You must comply with applicable laws, regulations, third-party service policies, and restrictions communicated by oceansim.io.

8. Prohibited Activities

You must not use oceansim.io for or in connection with:

Fraud;
Phishing;
Identity theft;
Impersonation;
Credential theft;
Account takeover;
Malware distribution;
Spam;
Unsolicited bulk messaging;
Financial fraud;
Money laundering;
Terrorist financing;
Sanctions evasion;
Illegal gambling;
Illegal goods or services;
Harassment or threats;
Telecommunications abuse;
Circumvention of security systems;
Circumvention of platform restrictions;
Automated abuse of third-party platforms;
Deceptive or harmful activities;
Any activity prohibited by applicable law.

You must not use oceansim.io to bypass or circumvent:

Account restrictions;
Verification systems;
Fraud-prevention systems;
Rate limits;
Geographic restrictions;
Security controls;
Suspensions or bans imposed by third-party services.

oceansim.io may suspend or terminate Accounts suspected of violating this section.

9. Account Registration

Certain Services require an Account.

You agree to provide accurate and current information during registration.

You are responsible for:

Keeping your password confidential;
Protecting your Account;
Protecting API keys and access credentials;
Preventing unauthorized access;
Immediately reporting suspected unauthorized access.

You must not:

Sell or rent your Account;
Transfer your Account without authorization;
Share credentials with unauthorized persons;
Create Accounts for fraudulent purposes;
Circumvent account restrictions;
Access another User's Account.

10. Virtual Numbers and Activations

A Number purchased through oceansim.io generally provides the User with a limited right to use that Number for the applicable Activation and Service.

Unless expressly stated otherwise, purchasing an Activation does not transfer ownership of the underlying telephone number to the User.

An Activation may be temporary and may expire after the applicable period displayed by the Platform.

After expiration, cancellation, completion, or termination of an Activation, the Number may:

Become unavailable;
Return to the Supplier;
Be reassigned;
Be recycled;
Become available to another User.

Users must not rely on temporary Numbers for permanent access to important accounts.

In particular, temporary Numbers should generally not be relied upon for:

Permanent account recovery;
Long-term identity;
Banking;
Financial accounts;
Government accounts;
Critical personal accounts;
Any account where continued control of a telephone number is essential.

11. SMS and OTP Delivery

oceansim.io provides technical access to SMS/OTP reception where available.

Delivery may be affected by:

Mobile networks;
Telecommunications infrastructure;
Supplier availability;
SMS routing;
Sender restrictions;
Third-party platform policies;
Number reputation;
Geographic restrictions;
Network congestion;
Technical failures;
Fraud-prevention systems.

oceansim.io does not guarantee that every SMS or OTP will be delivered.

oceansim.io also does not guarantee a particular delivery time.

12. Prices

Prices displayed on the Platform may vary depending on:

Country;
Service;
Number availability;
Network;
Supplier costs;
Routing;
Demand;
Operational conditions.

oceansim.io may change prices at any time.

The price displayed to the User at the time of purchase will generally be the applicable purchase price for that transaction.

13. Prepaid Balance

Services may be purchased using prepaid Balance associated with the User's Account.

Balance is intended solely for purchasing Oceansim Services.

Balance does not constitute:

A bank account;
A deposit;
An investment;
A financial product;
A cryptocurrency wallet;
Electronic money unless expressly classified as such under applicable law.

oceansim.io may restrict Balance where reasonably necessary for:

Fraud prevention;
Security;
Payment investigation;
Legal compliance;
Chargeback investigation;
Account protection;
Enforcement of these Terms.

14. Cryptocurrency Payments

At the time of publication of these Terms, oceansim.io may use third-party cryptocurrency payment platforms, processors, gateways, or payment service providers to facilitate cryptocurrency payments and account funding.

oceansim.io does not currently represent that it accepts payment by bank card, bank transfer, or other traditional payment methods.

Available cryptocurrency payment methods, networks, assets, minimum amounts, fees, confirmation requirements, and supported wallets may change at any time.

When making a cryptocurrency payment, you are responsible for:

Sending the correct cryptocurrency;
Using the correct blockchain/network;
Sending funds to the correct payment address;
Paying any applicable network fees;
Providing any required payment information;
Ensuring that the transaction is correctly completed.

Blockchain transactions are generally irreversible.

If you send cryptocurrency to an incorrect address, incorrect network, unsupported asset, or otherwise make an incorrect transfer, recovery may not be possible.

Third-party cryptocurrency payment providers may impose their own:

Fees;
Verification requirements;
Transaction limits;
Geographic restrictions;
Processing delays;
Compliance procedures;
Terms and policies.

oceansim.io is not responsible for delays, failures, losses, or restrictions caused solely by a third-party cryptocurrency payment provider or blockchain network, except where required by applicable law.

15. Refunds and Failed Activations

Refund eligibility depends on the circumstances of the Activation and the refund rules applicable to the relevant Service.

An Activation may qualify for a refund or Balance credit where, for example:

The requested SMS was not successfully delivered;
The Activation failed within the applicable refund period;
The Number was unavailable due to a technical or Supplier issue;
Another refund condition published by oceansim.io applies.

Refund eligibility may also depend on:

Whether an SMS was already received;
Whether the Number was already used;
Time elapsed;
Activation status;
Provider/Supplier records;
The applicable Service rules;
Evidence reasonably requested by oceansim.io.

If an SMS/OTP has successfully been delivered, the Service may be considered successfully provided.

A third-party platform subsequently rejecting, blocking, or restricting a Number does not automatically create a refund right where the Activation itself was successfully completed.

oceansim.io may reject fraudulent, abusive, repetitive, or unsupported refund requests.

Refunds may, where applicable, be provided as:

Oceansim Balance credit;
Reversal through the original third-party payment mechanism;
Another method permitted by the applicable payment provider.

Nothing in these Terms excludes mandatory consumer or statutory rights that cannot legally be excluded.

16. Cryptocurrency Refunds

Where a refund is approved for a cryptocurrency-funded transaction, the refund method may depend on the third-party cryptocurrency payment provider, blockchain network, transaction status, and applicable technical limitations.

Where permitted, refunds may be credited to the User's Oceansim Balance rather than returned through the original blockchain transaction.

Network fees, payment-provider fees, exchange-rate differences, or other third-party charges may affect the amount ultimately received where permitted by applicable law.

17. Payment Fraud and Chargebacks

Users must not use stolen, unauthorized, fraudulent, or unlawfully obtained funds to purchase Services.

Where a payment provider, cryptocurrency processor, or other third party identifies a transaction as suspicious or fraudulent, oceansim.io may temporarily restrict the related Account while the transaction is investigated.

Because cryptocurrency transactions are generally irreversible, Users should contact oceansim.io Support regarding payment problems before attempting unauthorized recovery methods or fraudulent disputes.

18. API Usage

oceansim.io may provide API access to eligible Users.

API access may be subject to:

Documentation;
Authentication requirements;
Rate limits;
Usage limits;
Security requirements;
Additional API policies.

You are responsible for protecting API credentials.

You must not:

Publish API keys;
Sell or transfer API credentials without authorization;
Circumvent rate limits;
Generate abusive traffic;
Attack or interfere with Oceansim infrastructure;
Attempt unauthorized access;
Reverse engineer protected API functionality;
Use the API for prohibited activities.

oceansim.io may restrict or revoke API access where necessary to protect the Platform, Users, Suppliers, or third parties.

19. Fraud Prevention and Security

oceansim.io may use automated and manual systems to detect:

Fraud;
Abuse;
Suspicious activity;
Multiple-account abuse;
Payment fraud;
Unauthorized access;
API abuse;
Automated attacks;
Other security risks.

oceansim.io may request additional information or verification where reasonably necessary.

Failure to complete required verification may result in restrictions or suspension.

20. Account Suspension and Termination

oceansim.io may suspend, restrict, or terminate an Account where reasonably necessary, including when:

These Terms are violated;
Fraud is suspected;
Illegal activity is suspected;
Payment abuse is suspected;
API abuse occurs;
Account security is compromised;
Required verification is not completed;
A Supplier or service provider requires restriction;
A competent authority requires action;
Continued access creates legal, security, operational, or financial risk.

Immediate suspension may occur where delay could create significant risk.

Where appropriate and reasonably possible, oceansim.io may provide notice regarding restrictions or termination.

21. Account Closure

Users may request Account closure through available account controls or by contacting Oceansim Support.

Closing an Account does not automatically create a right to receive a refund of remaining Balance.

Any remaining Balance will be handled according to the applicable refund rules, payment method limitations, applicable law, and outstanding obligations.

oceansim.io may retain information after Account closure where necessary for:

Legal compliance;
Fraud prevention;
Accounting;
Tax requirements;
Dispute resolution;
Security;
Enforcement of these Terms.

22. Intellectual Property

The Oceansim Platform and its associated materials, including:

Oceansim branding;
oceansim.io logo;
Website design;
Software;
Source code;
APIs;
Documentation;
Graphics;
Text;
Interfaces;
Databases;
Other proprietary materials

are owned by or licensed to oceansim.io and protected by applicable intellectual-property laws.

Except where expressly permitted, Users may not:

Copy;
Reproduce;
Modify;
Distribute;
Republish;
Sell;
Reverse engineer;
Create derivative works from;
Scrape or systematically extract

Oceansim proprietary materials.

23. Automated Access and Scraping

Unless expressly authorized, Users must not:

Scrape oceansim.io;
Crawl the Platform at abusive rates;
Systematically copy service inventories;
Extract pricing information for unauthorized purposes;
Reproduce the Oceansim interface;
Circumvent technical restrictions;
Interfere with Platform operation.

Where an official API is provided, Users should use the API rather than unauthorized scraping.

24. Service Availability

oceansim.io will use reasonable efforts to maintain the Platform and Services.

However, uninterrupted availability cannot be guaranteed.

Services may become temporarily unavailable due to:

Maintenance;
Software updates;
Infrastructure failures;
Supplier outages;
Telecommunications failures;
Network failures;
Cybersecurity incidents;
Regulatory requirements;
Force majeure events;
Third-party failures.

oceansim.io will take reasonable steps to restore affected Services where practicable.

25. Disclaimer

To the maximum extent permitted by applicable law, the Platform and Services are provided on an "as available" and "as is" basis.

oceansim.io does not guarantee that:

The Platform will always be available;
Services will always operate without errors;
Every Number will work with every third-party service;
Every Number will be newly issued;
Every Number will have no previous usage history;
Every Number will have a clean reputation;
Every SMS will be delivered;
Every OTP will be received;
A third-party service will accept a Number;
Services will satisfy every User's particular requirements.

Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

26. Limitation of Liability

To the maximum extent permitted by applicable law, oceansim.io will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including losses involving:

Profits;
Revenue;
Business opportunities;
Data;
Third-party accounts;
Reputation;
Expected savings.

oceansim.io is not responsible for losses caused by:

Third-party platforms;
Telecommunications operators;
Suppliers;
SMS providers;
Cryptocurrency payment providers;
Blockchain networks;
Internet infrastructure;
Actions taken by third-party services;
Previous use or reputation of a Number.

To the maximum extent permitted by law, oceansim.io's aggregate liability arising from a claim will not exceed the amount actually paid by the User to oceansim.io for the specific Service giving rise to the claim during the applicable period permitted by law.

Nothing in this section excludes liability that cannot legally be excluded.

27. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless oceansim.io and its operators, employees, contractors, affiliates, Suppliers, and service providers from claims, losses, liabilities, damages, penalties, costs, and reasonable legal expenses arising from:

Your violation of these Terms;
Your unlawful use of the Services;
Your violation of a third party's rights;
Your misuse of a Number or OTP;
Fraudulent or abusive activity through your Account;
Your violation of third-party service policies.

This obligation does not apply to the extent prohibited by applicable law.

28. Third-Party Websites and Services

The Platform may contain links, integrations, or references to third-party services.

oceansim.io does not control third-party services and is not responsible for:

Their availability;
Their content;
Their policies;
Their security;
Their actions;
Their treatment of your Account;
Their acceptance or rejection of Numbers.

Your use of third-party services is governed by their own terms and policies.

29. Privacy

Your use of oceansim.io is also governed by our Privacy Policy.

Our Privacy Policy explains how oceansim.io may collect, use, store, protect, and disclose personal information and service-related data.

By using the Services, you acknowledge that you have reviewed the Privacy Policy.

30. Electronic Communications

By using oceansim.io, you agree that we may communicate with you electronically through:

Email;
In-platform notifications;
Account notifications;
Support communications;
Other electronic communication methods associated with the Services.

Electronic communications may constitute written notices where permitted by applicable law.

You are responsible for maintaining access to the email address associated with your Account.

31. Changes to These Terms

oceansim.io may update these Terms from time to time.

Updated Terms will be published on the Platform with a revised "Last Updated" date.

Where required by applicable law, oceansim.io will provide additional notice of material changes.

Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

If you do not agree with revised Terms, you must stop using the Services.

32. Governing Law and Disputes

The parties should first attempt to resolve disputes through good-faith communication with oceansim.io Support.

If a dispute cannot be resolved informally, it shall be handled according to the applicable governing law and jurisdiction applicable to oceansim.io.

33. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.

The affected provision will be interpreted or replaced where legally permissible to best reflect its intended purpose.

34. No Waiver

Failure by oceansim.io to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision later.

35. Entire Agreement

These Terms, together with the Oceansim Privacy Policy, Refund Policy, API Terms or documentation, Acceptable Use Policy, and other policies expressly incorporated into these Terms, constitute the agreement between you and oceansim.io regarding use of the Services.

If there is a conflict between these Terms and a specific Service policy, the specific policy will govern only to the extent necessary for that Service.

Acceptance

By registering for an oceansim.io Account, accessing the Platform, adding Balance, purchasing a Number, receiving an SMS, or using an Oceansim API, you acknowledge that you have read, understood, and agreed to these Terms of Service.
